计算法学的体系思考与未来展望

摘要: 作为一门伴随计算方法在法学中的深入应用而产生的新兴交叉学科,计算法学对于发现法律系统运行规律、丰富法学研究方法、构建互联网法治基础至关重要。“计算法学”从兴起以来便得到了各大高校、科研机构的广泛关注,并已涌现出诸多成果。计算法学在我国的理论研究与实践应用仍有探索空间,其概念体系需要得到更好的建构,计算法学研究方法、计算法学的未来发展亦需汇聚更多共识。展望未来,构建计算法学知识体系、创新计算法学研究工具、探索计算法学新兴问题、培养计算法学复合型人才,将是计算法学学科不断建立健全的必由之路。

Systematic reflections and future perspectives on computational law science

Abstract: As a new interdisciplinary discipline that emerged from the indepth application of computational methods in law, computational law science is crucial to discovering the laws of legal systems, enriching legal research methods and building the foundation of the rule of law on the Internet. Since its emergence, computational law science has received widespread attention from universities and research institutions, and many achievements have emerged. There is still room for exploring the theoretical research and practical application of computational law science in China, and its conceptual system needs to be better constructed, and more consensus needs to be gathered on the research methods and future development of computational law science. It is a task that needs to be accomplished by researchers in computational law science, based on the present, gathering consensus and looking to the future.

0    引言

近年来,“计算法学”渐已成为法学研究的高频词汇。回顾过往,若干法学院校已经在不同层次开设了计算法学课程,部分院校在计算法学相关领域进行人才培养;学术期刊已刊载了代表性的文章探讨计算法学的概念、内涵及相应发展;多校共同发起中国计算法学发展联盟;中国计算机协会(CCF)也成立了计算法学行业分会以促进计算法学学科发展。前述各类成果,预示着计算法学正在兴起。
