生成式AI背景下著作权侵权样态及其风险治理

摘要： 生成式AI作为最先进科学技术的代表大跨步走进人们生活的同时，也带来了著作权侵权风险问题。生成式AI不同于以往的专家系统那样只进行简单的系统分析或者只关注现有数据，而是可以生成新颖内容的人工智能。该技术的产生对现行的著作权制度造成了冲击，对生成式AI技术的侵权样态分析迫在眉睫。通过对生成式AI技术挑战背景下著作权侵权样态进行分析，从而提出以下三条建议：面对数据输入阶段的侵权风险，应完善法定许可制度；面对数据分析阶段的侵权风险，要加强行政监管；面对数据输出阶段的侵权风险，要优化平台治理。

Copyright infringement patterns and risk management in the context of generative AI

Abstract： Generative artificial intelligence (AI), as a representative of the most advanced science and technology, has made significant strides into people′s lives, but it has also brought about the risk of copyright infringement. Generative AI is different from previous expert systems that only perform simple system analysis or focus on existing data, but can generate novel content through artificial intelligence. The emergence of this technology has had an impact on the current copyright system, and it is urgent to analyze the infringement patterns of generative AI technology. By analyzing the copyright infringement patterns in the context of generative AI technology challenges, the following three suggestions are proposed: in the face of infringement risks in the data input stage, the legal licensing system should be improved; In the face of infringement risks during the data analysis stage, administrative supervision should be strengthened; In the face of infringement risks during the data output stage, it is necessary to optimize platform governance.

0 引言
人工智能作为经济发展的新引擎，将成为新一轮产业变革的核心驱动力，并进一步释放历次科技革命和产业变革积蓄的巨大能量［1］。随着以GPT为首的生成式AI技术的逐渐成熟，利用该技术所生成的内容已然流入到了市场当中。技术的发展永远都是与风险相伴的，在生成式AI技术被人类应用到各个领域的同时，与之有关的著作权风险问题也引起了越来越多的学者重视，但有关生成式人工智能的著作权侵权问题却鲜少有人讨论。相关立法的缺失以及相关学术研究的不足，使得对于生成式AI技术挑战背景下著作权侵权问题的研究变得非常有价值。为了平衡作品的原著作权人获得预期收益与保障生成式AI技术稳步发展之间的利益，笔者将从以下三个部分（如图1所示）对生成式AI技术挑战背景下著作权侵权风险问题进行全面分析：首先，将对生成式AI技术的运行原理进行解析，阐明其对现存著作权制度的冲击；其次，对生成式AI技术的侵权样态进行全面的分析；最后，从数据输入、数据分析和数据输出三方面，提出平衡生成式AI技术与原版权人之间利益的措施。
