Research on the pathways for cross-border governance of data intellectual property under the overall national security concept

Abstract： Under the guidance of the overall national security concept, effectively managing cross-border governance of data intellectual property is of great significance for safeguarding national sovereignty, security, and development. Data intellectual property is not only a core asset for enterprises competing globally, but also a strategic resource that the state must strictly control. This dual nature leads listed companies, when fulfilling overseas information disclosure obligations, to face multiple risks, including loss of control over core data assets, leakage of supply-chain information, and involvement in geopolitical conflicts. Therefore, by establishing a classified and hierarchical data rights confirmation system, building a comprehensive sovereign shield for the entire lifecycle of cross-border data flows, and enhancing systemic counter-measure capabilities, orderly cross-border flow of data intellectual property can be realized on the basis of national security, providing a solid institutional guarantee for high-level openness and highquality development.
